#3 & #4: Dangerzone v Prime Mover (mark room)

Facts found

  • Falcon Shoal Pile (mark #10) is a fixed navigational beacon, extending approximately 10m above the water.
  • Prime Mover and Dangerzone were running on port gybe approaching mark #10. Prime Mover was to windward of Dangerzone.
  • At the zone, Prime Mover was overlapped to windward of Dangerzone.
  • Dangerzone (the leeward boat) altered course to windward to round the mark.
  • Prime Mover took avoiding action, by also altering course to windward, while Dangerzone altered course to leeward.
  • Prime Mover made contact with Dangerzone, her first reefing line became entangled in the arm of a crew member on Dangerzone. The crew member was injured, and Dangerzone suffered minor damage

Conclusion and rules that apply

  • Dangerzone failed to give Prime Mover mark room – rule 18.2(a).
  • Dangerzone changed course and failed to give Prime Mover room to keep clear – rule 16.1.

Decision

  • Dangerzone is disqualified.

#8 - Change to start time and number of races on 3 December 2016

The start time for racing on Saturday 3 December 2016 has been moved to 1100. The first warning signal will be made at 1055.

The plan is to complete at least three races. For Saturday 3 December 2016 only, NOR 10.11 and SI 18.11 are amended to remove the maximum number of races that may be conducted.

#7 - Latitude race rescheduled

The Latitude race has been rescheduled for Saturday 14 January 2016. The start time and warning signal times remain unchanged. This changes the Offshore Series Notice of Race and Sailing Instructions.

To avoid confusion, NTC #6 has been rescinded.

#6 - (Rescinded)

NTC #6 was rescinded by NTC #7 on 8 November 2016.

NTC #6 had the courses for the October 2016 Latitude Race. That race was abandoned due to weather, and rescheduled for 14 January 2017. A replacement course NTC will be published in due course.

#5 - Kapiti-Ship Cove Race; Change to start time; publication of race appendix

The start time of the Kapiti-Ship Cove Race will now be 2000 hrs 21 October 2016 (was 0800 hrs 22 October 2016). The briefing will be in the Wardroom at 1800 hrs 21 October 2016.

The race appendix has been published.

#4 - Change to method of calculating scoring penalty

Inshore Season sailing instruction 1.22 is changed to read:

Rule 44.1 is changed to permit a yacht that has broken a rule of Part 2 or rule 31 to take a penalty after racing but prior to any protest hearing. The penalty will be a scoring penalty as calculated in rule 44.3(c) equal to 40% of the score for Did Not Finish, or 50% of the difference between her finishing position and the score for Did Not Finish, whichever is less.

The Offshore Series sailing instructions are amended by adding a new instruction 1.9(j) which reads:

Rule 44.1 is changed to permit a yacht that has broken a rule of Part 2 or rule 31 to take a penalty after racing but prior to any protest hearing. The penalty will be a scoring penalty as calculated in rule 44.3(c) equal to 40% of the score for Did Not Finish, or 50% of the difference between her finishing position and the score for Did Not Finish, whichever is less.

For the purposes of the Inshore Season, Offshore Series, Latitude Race, and Cook Strait Classic, RRS 44.3(c) is changed to read:

The race score for a boat that takes a Scoring Penalty shall be the score she would have received without that penalty, made worse by the number of places stated in the sailing instructions. When the sailing instructions do not state the number of places, the penalty shall be 20% of the score for Did Not Finish, rounded to the nearest whole number (0.5 rounded upward). The scores of other boats shall not be changed; therefore, two boats may receive the same score. However, the penalty shall not cause the boat’s score to be worse than the score for Did Not Finish.

Explanation

A recent scoring penalty taken by Testarossa has highlighted a difficulty with applying RRS 44.3(c) and SI 1.22 given the race/series/season entry structure used by RPNYC. The changes above overcome that difficulty.

The new text for RRS 44.3(c) is taken from the Racing Rules of Sailing 2017-2020, and would have applied from 1 January 2017 regardless of this amendment.
